Please take the time to read and understand these Terms and Conditions (T&Cs). They govern your (your or you) use of the SportsMindset service as a participant.

SportsMindset reserves the right to change the Terms & Conditions from time to time.

The SportsMindset code of conduct that applies is the current version.

PRIVACY NOTICE: We generally collect your personal information for the purposes of processing and administering your services. Unless you advise us otherwise, we will also provide you with offers and information related to your participation which we believe will be of particular relevance and interest to you.

Buy purchasing and participating in our service, you agree to the T&Cs as a legally binding contract between you and SportsMindset Pty Ltd. Failure to agree will result in ineligibility to participate in SportsMindset programming.

Payment Agreement Contract

Session Fees & Packages
Your Fees are not refundable and non-transferrable.

Payment Options + Cancellations

SportsMindset requires the session or package amount to be paid in full at the date of purchase.
Each session and package has an expiry date by which those purchased sessions (or tokens) must be used. After this time, any remaining unused ‘tokens’ will expire. These conditions can be found listed with each product at the time of purchase.
Any cancellations less than 24hrs prior to the session or event start time, will not be eligible for transfer, and the session will be forfeited.
Any cancellations made within 48hrs will be eligible to transfer to another session to be held within 7days without penalty.
If participants withdraw from any event, session or package, no refund or transfer is available.
Should SportsMindset need to cancel any session, a ‘make-up’ session will be held or allocated, if participants cannot attend this, there will be no refund or transfer available.

Injury or illness

Should you wish to cancel your session/s and/or packages due to a significant injury or illness, SportsMindset may consider a refund of the full amount of remaining sessions less an administration fee of $50.00.

Participant Responsibilities
You must comply with the Terms & Conditions at all times while participating in SportsMindset sessions. Participants are directed in particular to the SportsMindset Code of Conduct.

You will be notified of material changes to the Terms & Conditions as soon as practicable after the changes come into effect.

Updated Terms & Conditions will be displayed on the SportsMindset website at www.sportsmindset.com.au

Examples of circumstances in which material changes to Terms & Conditions may occur, include responding to new laws, improving services to participants or to respond to changes in SportsMindset’s business or systems.

The participant must abide by any rules that SportsMindset may establish from time to time concerning the use of the service.

You must not:

damage or in any way alter the any property at the venue the session is being conducted in; or
create any disturbance or nuisance or do anything which poses a potential threat to the safety or welfare of any person at the venue or cause reputational damage to SportsMindset.

You must pay the costs of repairs, replacements or cleaning which are caused by you or your nominee/s use (other than as a result of ordinary use and wear and tear) such as graffiti, vandalism or additional cleaning requirements, which are directed to SportsMindset as a result of your actions.

Cancellation and Suspension of Services
Your purchased packages/services may be cancelled or suspended (for a period determined by SportsMindset) or you or your nominee/s may be removed from the session if you or your nominee/s: -

do not comply with any of the Terms & Conditions; or commit an act which would amount to a breach of the law (e.g. theft, public nuisance, disorderly conduct); or
SportsMindset staff or contractors form the opinion that your, or your nominee's, conduct has impacted on the enjoyment of other participants of the session.

If your packages/services are cancelled or suspended or you are removed from the session, no part of the remaining paid package is refundable, and no compensation is payable.

Age restrictions
All members aged below 18 years must have a parent or legal guardian sign these T&Cs.

Change of Participant Details

Members are required to advise SportsMindset administration team of any changes to their contact details. If any of your contact details have changed, please contact us on info@sportsmindset.com.au .

No Guarantee
SportsMindset does not give any assurance of guarantee that:

All sessions and/or programs, or any particular number of sessions and programs will be held at the nominated SportsMindset venues.

Conduct and Cancellation of Events
SportsMindset is not responsible for the manner in which an event and/or program is conducted by guest coaches and/or trainers;

SportsMindset is not responsible if you do not use your pre-paid package for an event and/or program which are you entitled to attend and no fee refund or any other compensation is payable by SportsMindset in those circumstances;

You acknowledge that some events and/or programs are subject to limited availability and/or capacity and pre-paid sessions or packages do not automatically entitle and/or ensure your attendance or place;

Privacy
Personal information that you disclose will only be used by SportsMindset and its staff and management. We will not share any of your information to a third party.

We may disclose any personal information as necessary to satisfy any law, regulation or government request.

Liability and disclaimer

Liability
Subject to any liability arising from SportsMindset own negligent acts or omissions, SportsMindset are not liable to you in respect of any loss or damage which you may incur from using the service, including any failure or omission on the part of a third party supplier or contractor, or other users, guests or patrons of the session and venue, and you release SportsMindset from any such liability.

SportsMindset do not make any representation as to the suitability or quality of your services purchased, nor warrant any representations made by any employee or agent of SportsMindset in respect of your sessions/packages which are not contained in the Terms & Conditions.

To the extent permitted by law, SportsMindset’s liability (if any) under the Terms & Conditions is limited, at SportsMindset’s option, to refunding the price of the goods or services in respect of which the infringement has occurred or to providing, replacing or repairing those goods or providing those services again.

If at any time any term or condition forming part of the Terms & Conditions is or becomes illegal or unenforceable in any respect, it will not affect the legality or enforceability of any other term or condition in the Terms & Conditions.

Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these Terms and Conditions and are not bound by implied terms.

WAIVER

I hereby agree to assume all risks and responsibilities surrounding my (or my child's) participation in the program under the instruction of SportsMindset trainers and coaches. I understand that similar to all sporting activities, there is a risk of damage to personal property, injury or death which may result from causes beyond the control of, and without fault or negligence of SportsMindset, its officers, agents, or employees, during the period of my (or my child's) participation. I understand completely the above agreement and agree to be bound thereby. By registering on our site you agree that we may send you email related to our facilities and programs. We will not provide your details to any other company
